WISE PUBLISHING PRESENTS: WISE PUBLISHING’S ENS SWEEPSTAKES OFFICIAL RULES

BY PARTICIPATING IN THE SWEEPSTAKES, YOU ACKNOWLEDGE AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS STATED HEREIN.

NO PURCHASE NECESSARY TO ENTER OR TO WIN.

SUBJECT TO APPLICABLE FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED.

Eligibility.

● Subject to the additional restrictions below, Wise Publishing’s ENS Sweepstakes, (the “Sweepstakes”) is open to legal residents of the 50 United States and the District of Columbia who are 21 years of age and older as of date of entry. Void in Puerto Rico and wherever else prohibited and/or restricted by law.

● Employees (and their immediate family members) of Wise Publishing (the “Sponsor”), all Wise Publishing Supplier/Vendor Partners (“Promotional Sponsor”) and each of their respective affiliates, divisions, related companies, and any other entity directly associated with this Sweepstakes are not eligible to enter.

● The Sweepstakes is subject to all federal, state, and local U.S. laws.

● By entering the Contest, the winner consents, to the extent permitted by law, to the use of their name, and general location, without compensation, in any publicity or advertising carried out in any medium by the Sponsor and/or its advertising or promotional agencies without limitation or further notification.

Promotional Period. The Sweepstakes will begin at 12:01 a.m. (EST) on March 14, 2023 and end at 11:59 p.m. (EST) on April 30, 2023 (the “Sweepstakes Entry Period”). Entries submitted before or after the Sweepstakes Entry Period will be disqualified.

How to Enter.

● During the Sweepstakes Entry Period, subscribe to the Moneywise newsletter via the landing page for the email contest subscription (the “Contest Subscription Page").

● Entrant will receive one entry for using the Contest Subscription Page to sign up for the
Moneywise newsletter. All Entrants must observe the following rules:​

(1) the sign up for the Moneywise newsletter must take place in the Sweepstakes Entry Period in order for entry to be valid;​

(2) the sign up must take place through the Contest Subscription Page – simply signing up for the newsletter does not enter one into the contest;

(3) each Entrant is limited to one email address for the purposes of the contest; and

(4) each Entrant agrees to the terms and conditions of Wise Publishing’s Terms of Service.

● Entrant must be willing to permit Wise Publishing to use their name and general location if they are a winner.

● Those who do not follow all of the instructions, provide a valid email address on their account, or abide by these Official Rules or other instructions of the Sponsor, may be disqualified. Any decision to disqualify is solely that of the Sponsor to use in its absolute and unfettered discretion.

Winner Selection.

1. An Entrant will be selected in a random drawing by Sponsor from among all eligible entries (the “Selected Entrant”) on May 1, 2023.

2. Upon notification, the Selected Entrant must, unaided, correctly answer a time-limited mathematical skill-testing question. In the event that the selected Entrant is unable to correctly answer the skill-testing question, the Sponsor shall have the right to randomly draw another eligible entrant, and the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. This method of selection of the winner will be repeated until an entrant unaided, correctly answers the time-limited mathematical skill-testing question. Odds of winning depend on the number of eligible entries received.

3. Upon correctly answering, unaided, the time-limited mathematical skill-testing question, the Selected Entrant will be declared the winner (“Winner”).

4. The Winner must complete and sign the declaration and waiver form (the “Declaration Form”) which will be transmitted by the Sponsor and must be returned to the Sponsor within five (5) business days of being sent. The Declaration Form shall contain confirmation of identity of the winner, confirm that they are 21 years of age or older, confirm that he/she has a Wise Publishing account/receives the Moneywise newsletter and that he/she has complied with the present Rules in their entirety.

5. The Winner must sign and return a Release form which will release and hold harmless Sponsor, its subsidiary and affiliated companies, and any other party associated with the development or administration of this Sweepstakes, and all of their respective officers, directors, employees, representatives and agents (collectively, “Releasees”) from and against any and all liability whatsoever, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damages, loss or destruction of property rights of publicity or privacy, defamation, or portrayal in a false light) in connection with this Sweepstakes or with the announcement, acceptance, ownership, or use or misuse of Prize and/or use of the Entry.

6. In the event of failure to observe any of the conditions mentioned above or any other conditions stipulated in these Rules, the selected Entrant may, at the Sponsor’s sole discretion, be disqualified and the Prize that would have been awarded will be forfeited and an alternative entry will be randomly drawn. This method of selection of the winner will be repeated until a winner is duly declared.

7. Wise Publishing shall have no liability for a winner's failure to receive notices due to the winner’s spam, junk e-mail or other security settings or for winner's provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.

Prize.

Prize. One (1) verified winner will receive $500.00 USD which will be paid directly by the Sponsor to the Winner either by electronic transfer or mail. TOTAL ARV OF THE PRIZE: $500.00 USD.

Any difference between stated approximate retail value and actual value of the prize will not be awarded. Odds of winning depend on the number of eligible entries received for each drawing.

General Conditions.

● The Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries.

● Sponsor reserves the right, in its sole discretion to cancel or suspend this Sweepstakes should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the game.

● With respect to computer entries, Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature.

● Entrants must have a valid email address. Should multiple users of the same e-mail account enter the Sweepstakes and a dispute thereafter arise regarding the identity of the Entrant, the authorized account holder of said e-mail account at the time of entry will be considered the Entrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted e-mail address.

If you are selected as the Winner, your information may also be included in a publicly-available Winners list and you consent to the use of your name and general location as set out above under “Eligibility”.

● Automated entries are prohibited, and any use of automated devices will cause disqualification. Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of their entries) who tampers with the entry process. Entrants may not register with multiple email addresses nor may Entrants use any other device or artifice to register multiple times or as multiple registrants. Any Entrant who attempts to enter with multiple email addresses under multiple identities or uses any device or artifice to register/play multiple times will be disqualified and forfeits any and all Prizes won, in Sponsor’s discretion.

● Prize is non-transferable. If a Prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute Prize with another Prize of equal or greater value. The Prize will be awarded only to an address within the United States (excluding Puerto Rico), DC. An unclaimed prize may not be awarded.

● The ARV of the Prize is based on available information provided to Sponsor and the value of any Prize awarded to a Winner may be reported for tax purposes where required by law. The Winner will be solely responsible for all applicable federal, state, and local taxes connected with the receipt of Prize, the use and enjoyment of Prize, or any other connection with this Sweepstakes unless otherwise required by law or unless this requirement is waived by the Sponsor in its sole discretion. The Winner will receive IRS Form 1099 for the ARV of Prize. The Winner may be required to provide Sponsor with a valid social security number or tax identification number before the Prize will be awarded for tax reporting purposes. As a condition of accepting the Prize, the Winner agrees to furnish any requested information needed for tax reporting.

● Entrants or Winners will be disqualified for any attempt to tamper with any aspect of the Sweepstakes, or circumvent these Official Rules. Sponsor reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by Sponsor that is fair and equitable to Sweepstakes Entrants. Sponsor reserves the right, in its sole discretion, to void, modify, terminate or suspend this Sweepstakes (or any portion thereof) should fraud or any unauthorized human intervention or other causes beyond the reasonable control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Sweepstakes.

● Laws in the Entrant’s country of residence may give Entrant the right to file claims before the courts of that country and may provide that some laws of that country are also applicable to this Sweepstakes. However, if any provision of the Official Rules or the application of any such provision to any person or circumstance shall be declared to be invalid, unenforceable or void, such decision shall not have the effect of invalidating or voiding the remainder of the Official Rules, it being the intent and agreement of the parties that the Official Rules shall be deemed amended by modifying such provision to the extent necessary to render it valid, legal and enforceable while preserving its intent or, if such modification is not possible, by substituting, therefore another provision that is valid, legal and enforceable so as to give effect to Sponsor’s intent. If and to the extent that English law applies to this Sweepstakes, or to any dispute arising in connection with this Sweepstakes, nothing in these Official Rules shall in any way limit or exclude liability for or in connection with (a) fraud, or (b) death or personal injury caused by negligence.

Disputes. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the Province of Ontario. By entering, Entrants consent to the jurisdiction and venue of the federal, provincial, state and local courts located in Toronto, Ontario.

By entering the Sweepstakes, the Entrants acknowledge having read and understood these Rules and agree to be bound by them and to comply with them. The Entrants declare that the Rules are understandable and reasonably available for consultation.

● Winner List. To request the winner’s first name and surname initial please send a self-addressed stamped envelope to Wise Publishing’s Referral Sweepstakes Winners, 40 Eglinton Ave. East, Toronto, ON, K2P 0G2. Winner List requests will only be accepted after promotion end date listed above.
